1. Acceptance of Terms
By accessing, browsing, or using any products, services, platforms, applications, tools, APIs, models, outputs, or any other offerings (collectively, “Services”) provided by the ETHOS (“ETHOS,” “we,” “us,” or “our”), you (“User,” “you,” or “your”) acknowledge that you have read, understood, and agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms in their entirety, you must immediately discontinue all use of our Services.
These Terms constitute a legally binding agreement between you and ETHOS. Your continued use of any Services after any modification to these Terms shall constitute your acceptance of such modifications.
2. Description of Services
ETHOS provides artificial intelligence and deep learning-based products and services related to body language analysis, nonverbal communication research, behavioral signal processing, and related computational disciplines. Our Services leverage advanced machine learning models, neural network architectures, and proprietary algorithms to analyze, interpret, and generate insights related to nonverbal human behavior.
3. Experimental Nature of Services
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT ALL SERVICES PROVIDED BY ETHOS ARE EXPERIMENTAL, RESEARCH-GRADE, AND INHERENTLY UNSTABLE IN NATURE.
Our Services are built upon artificial intelligence and deep learning technologies that are, by their fundamental nature, probabilistic, non-deterministic, and subject to error, hallucination, misclassification, and unpredictable behavior. Outputs generated by our Services may be inaccurate, incomplete, misleading, inconsistent, or otherwise unreliable. No output from any ETHOS Service should be treated as definitive, diagnostic, therapeutic, legal, or professional advice of any kind.
Our Services are the product of ongoing, continuous research and development conducted 24 hours a day, 7 days a week. As such, all Services, models, features, functionalities, interfaces, APIs, and outputs are subject to constant modification, update, recalibration, deprecation, or removal at any time, without prior notice, as part of our normal research and development cycle. You acknowledge that the version of any Service you use today may behave materially differently from the version available tomorrow.
4. No Reliance; Assumption of Risk
You shall not rely upon any output, result, analysis, classification, prediction, interpretation, or other information generated by our Services for any purpose that could result in harm, loss, damage, or adverse consequences to yourself or any third party. This includes, without limitation, medical, psychological, legal, financial, employment, security, law enforcement, or any other consequential decision-making.
BY USING OUR SERVICES, YOU ASSUME ALL RISK ASSOCIATED WITH SUCH USE. You acknowledge that you are using experimental AI-based technology at your own risk and that you have been fully informed of the inherent unpredictability and instability of such technology.
5. Waiver of Claims
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU HEREBY IRREVOCABLY AND UNCONDITIONALLY WAIVE, RELEASE, AND FOREVER DISCHARGE ETHOS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, AND ASSIGNS FROM ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, DAMAGES, LOSSES, COSTS, EXPENSES (INCLUDING ATTORNEYS' FEES), AND LIABILITIES OF EVERY KIND AND NATURE, WHETHER KNOWN OR UNKNOWN, SUSPECTED OR UNSUSPECTED, DISCLOSED OR UNDISCLOSED, ARISING OUT OF OR IN ANY WAY RELATED TO:
- Your use of, access to, or inability to use any Services;
- Any inaccuracy, error, omission, or defect in any output or result generated by our Services;
- Any modification, update, interruption, suspension, or discontinuation of any Services;
- Any decision or action taken by you or any third party based on outputs from our Services;
- Any data processing, analysis, or handling conducted by our Services;
- Any unauthorized access to, alteration of, or loss of your data or transmissions;
- Any conduct, content, or behavior of any third party in connection with our Services;
- Any other matter relating to our Services, regardless of the theory of liability.
6. Disclaimer of Warranties
ALL SERVICES ARE PROVIDED “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS,” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED.
ETHOS expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including without limitation any warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, completeness, timeliness, availability, compatibility, title, quiet enjoyment, and any warranties arising from course of dealing, usage of trade, or course of performance.
Without limiting the foregoing, ETHOS makes no warranty or representation that: (a) any Service will meet your requirements or expectations; (b) any Service will be uninterrupted, timely, secure, error-free, or free of viruses or other harmful components; (c) any results or outputs obtained from any Service will be accurate, reliable, complete, or current; (d) any defects in any Service will be corrected; or (e) any Service is compatible with any particular hardware, software, or system.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ETHOS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, USE, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF ETHOS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL ETHOS'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF ANY SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU HAVE PAID TO ETHOS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
8. Indemnification
You agree to indemnify, defend, and hold harmless ETHOS and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use of any Services; (b) your violation of these Terms; (c) your violation of any applicable law, regulation, or third-party right; (d) any content, data, or information you provide to or through our Services; or (e) any decision or action taken based on outputs from our Services.
9. Intellectual Property
All Services, including but not limited to all software, algorithms, models, architectures, methodologies, processes, techniques, interfaces, designs, documentation, trade secrets, and know-how, are and shall remain the exclusive property of ETHOS and are protected by intellectual property laws and international treaties. No license, right, title, or interest in any intellectual property is transferred to you by these Terms or your use of any Services, except the limited right to use the Services in accordance with these Terms.
You shall not reverse engineer, decompile, disassemble, copy, modify, distribute, sublicense, or create derivative works based on any Service, in whole or in part, without the prior written consent of ETHOS.
10. Data Processing & Analysis
You acknowledge and agree that all data, inputs, content, and information you provide to or through our Services may be processed, analyzed, and utilized by our AI systems using a variety of tools, techniques, models, and methods for the purposes of providing, improving, and developing our Services. This may include, without limitation, automated processing by machine learning models, statistical analysis, pattern recognition, behavioral classification, and other forms of computational analysis.
As of the last update of these Terms, data submitted to our Services is not permanently stored beyond the processing session. However, we reserve the right to modify our data retention practices at any time. Any changes to data retention or storage practices will be reflected in an updated version of our Privacy Policy. Your continued use of our Services following any such update constitutes your acceptance of the revised practices.

11. Modifications to Terms & Services
ETHOS reserves the right, at its sole discretion, to modify, amend, supplement, or replace these Terms at any time. All modifications are effective immediately upon posting the updated Terms. It is your sole responsibility to review these Terms periodically. Your continued use of any Services following the posting of modified Terms constitutes binding acceptance of such modifications.
ETHOS further reserves the right to modify, suspend, discontinue, or terminate any Service, feature, or functionality at any time, for any reason, with or without notice, and without liability to you or any third party.
12. Force Majeure
ETHOS shall not be liable for any failure or delay in performance of any obligation arising from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, civil unrest, government actions, embargoes, labor disputes, equipment failures, power outages, internet disruptions, cyberattacks, or any other force majeure event.
13. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or your use of any Services shall be resolved exclusively through binding arbitration, except where prohibited by law. You agree to waive any right to a jury trial or to participate in a class action lawsuit or class-wide arbitration.
14. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect the remaining provisions, which shall continue in full force and effect. The invalid or unenforceable provision shall be replaced with a valid, enforceable provision that most closely approximates the intent and economic effect of the original provision.
15. Entire Agreement
These Terms, together with our Privacy Policy and any other policies or agreements referenced herein, constitute the entire agreement between you and ETHOS with respect to the subject matter hereof and supersede all prior and contemporaneous agreements, understandings, negotiations, and discussions, whether oral or written, between the parties with respect to such subject matter.
